Cortex Sports Analytics

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Veridian Data Analytics, operating as Cortex Sports Analytics (“Cortex,” “we,” “us,” or “our”). By accessing or using the Cortex Sports Analytics website and services (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Services

Cortex Sports Analytics provides sports analytics, statistical modeling, performance analysis, and related insights regarding sporting events, teams, and players. The Service includes predictive analytics, win probability models, matchup narratives, fantasy baseball alerts, rookie tracking, and related dashboards. All information is provided for informational and analytical purposes only. The Service is a 2026 MLB season launch product, with additional sports (NFL, NBA) planned for future seasons.

3. No Gambling or Financial Advice

Cortex Sports Analytics does not provide gambling advice, betting recommendations, or financial advice of any kind. Any projections, win probabilities, or model outputs represent analytical opinions derived from statistical models and historical data. They should not be interpreted as guarantees of future outcomes, investment advice, or recommendations to place wagers. Users assume full responsibility for any decisions made based on information provided through the Service.

4. Accuracy and No Warranty

Sports outcomes are inherently uncertain. Cortex Sports Analytics makes no representations or warranties, express or implied, regarding the accuracy, completeness, timeliness, or reliability of any information provided through the Service. The Service is provided “as is” and “as available” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

5. Accounts and Eligibility

To access certain features, you must create an account via Manus OAuth. You must be at least 18 years of age to use the Service. By creating an account, you represent that all information you provide is accurate and that you will maintain the accuracy of that information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

6. Subscriptions and Billing

Cortex Sports Analytics offers both a free tier and paid subscription plans. Paid subscriptions are billed and managed through Stripe (stripe.com). By subscribing to a paid plan, you agree to Stripe’s terms of service and authorize recurring charges to your payment method at the applicable subscription rate.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or through the Stripe billing portal. Cancellation takes effect at the end of the current billing period. Refunds are available within 30 days of any payment in accordance with our Refund Policy.

We reserve the right to modify subscription pricing with reasonable advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

7. Intellectual Property

All analytics models, proprietary metrics, reports, visualizations, dashboards, software tools, and branding — including the Cortex Sports Analytics name and brain logo — are the intellectual property of Veridian Data Analytics or its licensors and are protected by applicable copyright, trademark, and trade secret laws. Users may not reproduce, distribute, sell, sublicense, publicly display, or republish any Cortex content without prior written permission. Unauthorized use may result in account termination and legal action.

8. User Conduct

By using the Service, you agree not to:

  • Attempt to reverse engineer, decompile, or extract the underlying analytics models or algorithms.
  • Scrape, crawl, or systematically download data from the Service without written authorization.
  • Use the Service to build a competing product or service.
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
  • Share account credentials or allow unauthorized third parties to access your account.
  • Use the Service in violation of any applicable local, state, national, or international law.

9. Third-Party Data and Services

The Service incorporates data from third-party sources including MLB Stats API, Baseball Savant (Statcast), and other publicly available sports data providers. We are not responsible for errors, omissions, or delays originating from those sources. The Service also integrates third-party services including Manus OAuth (authentication), Stripe (billing), and Umami Analytics (usage analytics). Your use of those services is subject to their respective terms and privacy policies.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Veridian Data Analytics and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or damages arising from reliance on analytics outputs, service interruptions, or unauthorized access to your account.

In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the greater of (a) the total amount you paid to Cortex Sports Analytics in the twelve months preceding the claim, or (b) fifty US dollars (USD $50.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless Veridian Data Analytics and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, limitation of liability, and governing law.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in English, with proceedings held in Colorado. Each party shall bear its own costs unless the arbitrator determines otherwise. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. To the extent that any dispute is not subject to arbitration under Section 13, you consent to the exclusive jurisdiction of the state and federal courts located in Colorado.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the Effective Date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
